Head of Chambers, Mr Robert Smith QC has appeared in front of the Supreme Court to argue a point of law of general public importance arising out of the interpretation of Section 3ZB of the Road Traffic Act 1988 (causing death by driving a motor vehicle when uninsured/disqualified/without a licence).

Mr Smith argued that ordinary principles of causation had to be applied in the case of a defendant driver where the cause of the collision was entirely due to the fault of the deceased.  The appeal lay from the Recorder of Newcastle, HHJ Hodson and the Court of Appeal Division, presided over by Lord Justice Hooper.  The Supreme Court has reserved its decision.
