Simon Phillips QC represented the General Medical Council, responding to an application by a consultant gynaecologist for permission to apply for judicial review of a decision by the Assistant Registrar of the GMC to waive the “five year rule” under Rule 4(5) of the Fitness to Practise Rules 2004. Mr Justice Stewart refused the doctor’s application on 24 October 2014.
