Adam Birkby instructed by Carr & Co Solicitors, Huddersfield, successfully defended a man of good character charged with assault by penetration. The issue at trial was consent. Following a successful application under section 41 of the Youth Justice and Criminal Evidence Act 1999 Adam cross-examined the complainant as to the true nature of her sexual relationship with the defendant and the various inconsistencies in her evidence. Following a 4-day trial the defendant was unanimously acquitted within 25 minutes.”
