Nicholas de la Poer in Court of Appeal

Nicholas de la Poer, instructed by Howard and Byrne, Solicitors of York, successfully appealed against the conviction of Correy McGuffog for causing death whilst driving otherwise than in accordance with a licence.

Mr McGuffog’s conviction was 3 and a half years ago, but following a change in the law, Mr de la Poer managed to persuaded the Court of Appeal that a large extension of time for appealing was justified due to substantial on-going injustice to Mr McGuffog. As a result, the Court quashed the conviction.

Colin Byrne, of Howard and Byrne, who gave a witness statement in support of the appeal and whose firm was commended by the Court for identifying the change in the law expeditiously, expressed himself as delighted with the result for his client.
