Jeremy Barton successfully defended an off-duty police officer who was alleged to have assaulted a female whilst enjoying a night out.
The incident occurred inside a nightclub and was captured in full on CCTV installed inside the venue.
The officer alleged that he was acting in reasonable self defence when he was seen to strike the female to the face with his hand as she approached him, knocking her backwards.
The complainant and a number of witnesses gave evidence that the force used was not necessary and disproportionate. However, through cross examination and careful scrutiny of the CCTV the officer was shown to have acted based on a reasonably held belief that the complainant was about to strike him.
