The jury returned unanimous verdicts of guilty against Iceland in relation to health and safety offences. Iceland were investigated following the death of a maintenance contractor, who fell from an unguarded platform area when carrying out a routine filter change at the Rotherham store.
Nicholas de la Poer was instructed by Rotherham Metropolitan Borough Council to advise pre-charge and conducted the trial which led to the verdicts. Iceland was convicted of 1 offence of exposing employees to a risk of danger and 1 offence of exposing non employees to a risk of danger under sections 2 and 3 of the Health and Safety at Work Act 1974. The period of the offending was 9 months.
Iceland will be sentenced later this year.
