The offence alleged involved use of a firearm and took place at a residential location. The prosecution relied upon telecommunications data and cell site analysis to show that the defendant was involved and present at locations consistent with the offence. A number of expert witnesses were relied upon to give evidence on behalf of the prosecution, however Mr Barton successfully challenged the reliability and interpretation of that evidence. After a six weeks of evidence, Mr Barton’s client was one of only two acquitted.
