Susannah Proctor successfully appealed extended sentence for sexual offending from Court Martial to the Court of Appeal.

07/08/2019

Susannah Proctor was instructed to review the case after the sentence had been passed by the Courts Martial.  It was her view that the sentence was manifestly excessive, and she settled grounds of appeal identifying a number of errors in the sentencing process.

The Court of Appeal, agreeing with the contention that the sentence was too long, quashed the extended sentence of 9 years [5 years extended license] given at the Court Martial at Catterick for a Corporal who pleaded to 3 allegations of sexual assault against a child under 13. The sentence was substituted for a determinate term of 3 years 4 months.

Susannah was instructed by Mark Whitfield of ABR Solicitors.
