Following a trial lasting for eight weeks before Mr. Justice Goss at Sheffield Crown Court, Jonathan Garner was convicted of the murder of the twenty-three month old child and her mother, Samantha Gregson, was convicted of Causing or Allowing the Death of Mia, contrary to section 5 of the Domestic Violence, Crime and Victims Act 2004. In this case in which neither defendant was prepared to give an account the prosecution relied upon significant expert evidence to demonstrate that injuries consistent with smothering had been overlooked by the original pathologists. The experts relied upon included a paediatric pathologist, paediatric cardiologist, paediatric and neuro radiologists and forensic odontologist.
