Jeremy Barton secures a suspended sentence for a police officer convicted of Misconduct In Public Office

The defendant faced serious allegations arising out of a sexual relationship that had formed between him and the complainant in an investigation, contrary to police ethics and professional standards. 

Despite the seriousness of the case,  Jeremy was able to distinguish the current case from a series of recent authorities that were decided to the contrary, including a successful Attorney General’s Reference where the Court of Appeal replaced a suspended sentence with a term of immediate prison. The cases cited by the prosecution were R v Longmate [2024] EWCA Crim 443,  R v Hamza [2017] EWCA Crim 1217 / 2 Cr App R (S) 47, AG’s Reference (No. 30 of 2010) (R v Bohannan)[2010] EWCA Crim 2261 / [2011] 1 Cr App R (S) 106.
