Marte Alnaes accepts instructions in a wide range of areas, including Crime, Regulatory, Civil and Family.

Marte completed her pupillage under the supervision of Chloe Fairley, during which she experienced a wide range of work and practice areas such as Crime, Family and the GMC. She has since built on that experience and now has a busy practice frequently dealing with factually complicated cases involving complex areas of law.

Marte takes pride in her approachability, building rapport with her clients.  She focuses on putting them at ease during all stages of the court proceedings.

Marte is originally from Norway and as such is fluent in most of the Scandinavian languages. She has a particular interest in languages and studied German in school and at college and completed a semester of Portuguese while she studied for her LLB.

Marte defends and prosecutes in trials concerning serious violence, drugs offences, acquisitive crime, domestic violence, harassment and sexual offences. She also undertakes the full range of interlocutory work involved in such proceedings.

Notable Cases

  • R v JS (2022)

    Instructed to defend a man accused of various serious offences, such as attempt burglary and burglary, dangerous driving and attempt s. 18. The burglary was not proceeded with due to careful analysis of the available CCTV. Defence contended that the footage showed the Defendant was not guilty, and this was eventually accepted by the Crown. The remaining offences were resolved by way of acceptable pleas. A final sentence of 37 months was imposed.

  • R v JP (2022)

    Instructed to prosecute a police constable accused of assault occasioning actual bodily harm and perverting the course of justice.

  • R v MB (2022)

    Instructed to defend a youth accused of causing grievous bodily harm to his ex-girlfriend. Careful cross-examination ultimately led to the Defendant’s acquittal.

  • R v JP (2022)

    Instructed to prosecute a Defendant for making indecent images of children. The Defendant was found to be in possession of nearly 24,000 images and to have distributed over 80 images. The Defendant received a sentence of 3 years’ custody.

  • R v AT (2022)

    Instructed to prosecute in a drugs and firearms case. The Defendant had been caught with class A drugs and there was voluminous phone evidence to suggest on going dealing. The Defendant did not have a firearms certificate, but ammunition was found within his vehicle.

  • R v FM (2021)

    Instructed to defend a Defendant accused of robbery and threats to kill. Throughout examination of the evidence and lack therefore of suggested the Complainant had fabricated the allegation. The Defendant was acquitted.

  • R v N (2021)

    Prosecution of a Vietnamese national accused of cultivating cannabis. The Defendant alleged he had been coerced and forced into the offending but his defence that he had acted under duress was rejected by the jury.

  • R v R (2021)

    Instructed to defend a man accused to causing grievous bodily harm with intent. The Defendant had been charged with hitting the Complainant with a mug twice, causing significant facial injuries. The Defendant entered a guilty plea to s. 20, but this was not accepted by the Crown. The Defendant was later aquitted of causing grievous bodily harm with intent and a suspended sentence of imprisonment was later imposed in respect of the Defendant’s guilty plea to s. 20.

  • R v AB (2021)

    Instructed to prosecute an appeal against conviction in the Youth Court. The Defendant was 13 years’ old and the Complainant was aged 12. This serious assault case involved multiple young and vulnerable witnesses.

  • R v B & J (2020)

    Marte acted as temporary junior counsel led by Simon Kealey QC in the successful prosecution of two defendants for murder.

Marte frequently represents those involved in civil litigation arising out of road traffic accidents where either or both liability and quantum have been in dispute. She has a proven track record of dealing with credit-hire cases and also a growing bank of knowledge and experience of claims concerning breach of contract.

 

Marte has experience of both small claims and fast-track proceedings and has provided written advice in a number of different types of proceedings.

Marte regularly accepts instructions in applications for non-molestation orders and child arrangements orders. Her experience of family litigation involves both written work and court appearances.

She was recently instructed by Durham County Council in a lengthy public law case, and is used to handling cases involving large amounts of papers and complicated factual backgrounds.

Notable Cases

  • Re X (2022)

    Instructed to represent the Applicant in non-molestation order proceedings. Marte helped secure protection of her client by negotiating a lengthy undertaking from the respondents.

  • Re Y (2022)

    Instructed to represent the Respondent. The Applicant had applied for a specific issue order in an attempt to prevent the Respondent from taking their children on an already booked holiday 3 days later. The matter was settled by way of alternative orders after negotiation, allowing the Respondent to take the children on holiday.

  • Re Z (2021)

    Instructed to represent the Applicant in child arrangement order proceedings. The Respondent had a history of making groundless applications. Marte secured a child arrangements order after negotiations and an order under s. 91(14) preventing the Respondent from making further baseless applications.

Marte has an emerging practice in Regulatory Law having been, by way of example, recently instructed by Scarborough Borough Council to represent their interests in the Crown Court in respect of enforcement proceedings being brought in respect of multiple breaches of the selective licencing regulations.

 

Marte is also regularly instructed by Social Work England, the regulatory body for social workers. She appears both in interim hearings and in the substantial final hearings and frequently assists in drafting of documents and advising on the law, procedure and the factual strength of cases.
