Thomas Moran practises in serious crime and professional regulatory work.

He acts for the prosecution and defence, but with an emphasis on defence work. His work has included numerous difficult and high profile criminal cases, many involving professionals such as teachers, doctors, nurses, etc.

He also holds four part-time judicial appointments, is an advocacy trainer and an independent assessor of CPS higher court advocates. He is a member of the GMC panel of fitness to practise counsel.

Tom has been instructed in a number of high profile and complex homicides in recent years.

  • R v RM [2012]

    Manslaughter, alleged baby shaking. Case involving multi-disciplinary medical approach especially in relation to the so-called ‘triad’ of injuries.

  • R v LT [2012]

    Manslaughter, complex issues of causation, intervening act and joint-enterprise.

  • R v CN [2010]

    Murder, torture of man with learning difficulties.

  • R v SO [2010]

    Murder of elderly mother by son. Complex biomechanical and medical evidence as to whether victim fell or was pushed down stairs and as to time of death.

  • R v TH et al [2009]

    Murder of man by three youths. Case prompted national campaign on knife crime.

Tom is regularly instructed by the prosecution and the defence in the most serious sexual allegations. In the last year he has been instructed in rape cases by eight different firms of solicitors. He has a keen interest in the use of medical evidence in such cases and has attended seminars with medical practitioners to discuss the issues arising in these cases. Tom also has considerable experience in cases involving young defendants and defendants with learning difficulties.

    Buggery and other offences committed up to 49 years ago. Issues of abuse of process and doli incapax.

  • R v RT [2012]

    Serious sexual offences against boys. Defendant 85 years old.

  • R v BW [2012]

    Rape, defendant and complainant suffering serious learning difficulties.

  • R v RS [2012]

    Rape, relevance of voluntary intake of cannabis on consent and belief in consent.

  • R v SM [2011]

    Rape by two defendants, offence filmed on mobile phone by one of them.

  • R v RH [2011]

    Rape by church leader.

Tom has a discrete practice in crime-related judicial review and case stated. He has acted in a number of cases of constitutional importance.

    Multiple fatal road accident, propriety of prosecution changing mind as to prosecution following campaign by victims’ families.

  • R v D

    Propriety of High Court judge directing prosecution to charge additional offences in a historic sex case in order to increase sentencing power. New charges initially stayed by justices, stay then quashed by Divisonal Court.
